Citizen observatory of aircraft overflights
Legal notice and terms of use
Who provides this service and on what terms.
In short: looking at the data is free and asks nothing of you. An account lets you receive alerts and, if you choose, file complaints in your own name.
Those complaints are yours: you sign them, you answer for what they say, and the reply comes to you. This site prepares the letter and sends it when you ask; it does not represent you or complain on your behalf.
Who provides the service
- Provider: Lucas Rodríguez Costantino
- Tax ID: X9212656Y
- Address: Passeig Marítim, 104, 08860 Castelldefels (Barcelona)
- Contact: hola@avisos.defels.es
The service is free: there is no charge for looking at the data, having an account or sending letters.
What this is and what it is not
It is an observatory of overflights and aircraft noise over your area. The data comes from public sources and is processed with written rules, which are explained in the methodology.
What that means, and it is worth being clear about before using a figure:
- The data may have gaps, delays or errors, because it depends on sources we do not control. When a figure is missing, we say so; it is not filled in with an estimate.
- It is not an official record or an expert report. The figures document what was published and when, not certify what happened.
- A classification is not an accusation. A flight shown as open to complaint means that, under the published rules and the available data, none of the written grounds that justify it were on record. It does not mean anyone broke any rule.
Your account
- The account is personal: one person, one email address. You sign in with a code sent to your email or with your Google account.
- The details you give must be true, above all your name and surname, because they are used to sign what you send.
- You can download everything that is yours and delete the account whenever you like, from the account itself.
The complaint letter service
This is the part that carries the most responsibility, so it is explained in full.
You file it. Each letter goes out in your name, signed with your name and surname, and is filed as your own personal complaint. There is no collective complaint and no sending on behalf of someone else.
What this site does:
- It prepares the text from the data for the flight or the day and from whatever you add.
- It sends it only when you ask. Flight by flight, it shows you the letter before sending it. On days with many flights open to complaint, you can authorise grouped sending for that particular day: you see the model the letters come from and what they will contain, and the authorisation is valid for that day and no other, and never renews itself.
- It sends it from its own mailbox, with your email as the reply-to address and a copy to you, so you have the document exactly as it was filed. Where the town council has asked for it, the same message also goes in copy to the municipal office.
What it does not do:
- It does not represent you: it is not a legal adviser or an agent, and it does not act under any mandate from you.
- It does not follow up the case, read the replies you receive or answer on your behalf.
- It does not guarantee that the receiving body will reply, nor how, nor when.
- It does not advise you on whether to complain or on other routes, such as appeals, reports or lawsuits.
What you answer for:
- That the letter is yours: that you send it under your own identity and not someone else’s.
- What you add in your own words —for example, how a flight affected you—: that it is true and contains no insults, threats or details of other people.
- That what is sent is true in your case. If something is not, do not send it.
Sending limits. So that a fault cannot turn into hundreds of emails, there is a daily cap on letters for the whole service. If it is reached, or if a send fails, the letter does not go out and is not treated as sent: you can ask for it again.
What is not allowed
- Using someone else’s account or sending letters under a name that is not yours.
- Using the forms to send emails to people who did not ask for them.
- Automating the sending of letters or sign-ups, or trying to get around the limits.
- Trying to access parts of the service or data that are not yours.
If an account does any of this, we may suspend its letter sending or close it, and we will tell you by email and explain why. Before anything is deleted you will have the chance to download your data, unless the law requires otherwise.
Availability and liability
The service is provided as it is, with no guarantee that it will always work or be free of errors. It may be interrupted for maintenance or because of failures in the sources or the technical providers.
We are not liable for decisions you make based on the data or for the outcome of the complaints you file. This does not limit any liability that the law does not allow to be limited, in particular for wilful misconduct or gross negligence.
Ownership of the content
The texts, design and code of this site belong to the service provider. The figures and charts may be quoted and shared, stating that they come from cielo.defels.es.
When these terms change
If they change in a way that affects you, we will tell you before the change applies, and the version is shown at the foot of the page. If you do not agree, you can delete your account; continuing to use it after the stated date means accepting the change.
Governing law
These terms are governed by Spanish law. In the event of a dispute, you may go to the courts of your place of residence.
